Section 5
Provisions relating to party registration

(1) In order to register a party in accordance with section 4, the chief officer of the party shall submit an application to the Commission in the prescribed format along with the decision of the Central Committee, attaching the following details and documents:-
(a) Constitution of the Party,
(b) Declaration,
(c) Flags, models of insignia,
(d) At least 500 Nepali voters' commitment letter to get membership of the party and their signature along with a certified copy of their citizenship or voter ID card,
(e) A declaration stating that the person making the commitment as per clause (d) is not a member of the other party,
(f) Provision of a Central Committee of at least twenty-one members, and
(G) Other details and documents deemed necessary by the Commission.
(2) The Commission shall make necessary inquiries on the application received under sub-section (1).
(3) For the purpose of sub-section (2), the commission may discuss with the chief officer or member of the central committee of the proposed party, request any additional details or necessary documents or get their signatures to be authenticated in the prescribed format.
(4) If it appears from the investigation as per sub-section (2) that the proposed party can be registered in accordance with the Constitution and this Act, the commission shall register such party within forty-five days after receiving the application in accordance with sub-section (1) and issue a party registration certificate and inform the petitioner of the reason if registration is not possible. .
(5) When registering a party according to sub-section (4), it shall be recorded in the party registration book with the specified details.
